Please read this Service Agreement
The Company is the supplier of Shelley Osman ~ The Connection Way ® services and the Customer wishes that the Company provide those services to it.
This Shelley Osman ~ The Connection Way ® Agreement ("Agreement") sets out certain terms applicable to the Company’s supply, and the Client’s acceptance, of those VIP services and forms part of the Contract between the Company and the Customer for those services.

DEFINITIONS
““Guidelines” means any guidelines, rules or regulations made by Authority that is applicable to the Services.
“Authority” means Shelley Osman ~The Connection Way ® (shelleyosman.com) or relevant regulating authority that has the right to frame Guidelines for the Services.
“Services” means Shelley Osman ~ The Connection Way ® Services provided by the Company and described on the Website as ‘The Connection Way ® Teachings’, ‘Healing Connections’, ‘Prayer connections’, ‘End of Life connections’ ‘Online events’, ‘Retreat events’
“Products” means Shelley Osman ~ The Connection Way ® products, described in detail on the website as, ‘audio CD’, ‘MP3 Audio library’, ‘audio download’, ‘Calendar’, ‘Healing Candles’, ‘Healing crystals’, ‘Incense burners & candle holders’, and ‘MP4 Videos’.
2. SCOPE OF SERVICES
Customer hereby engages Company to perform, and Company hereby agrees to perform the Services for Client, as described in detail on the Website at URL www.shelleyosman.com
3. COMPANIES OBLIGATIONS
3.1 We have a legal duty to supply any of the Connection Way Services in conformity with the Contract and will not have conformed if it does not meet the following obligation.
Upon delivery, the Services will:
a. be of satisfactory quality;
b. be reasonably fit for any particular purpose for which you book the service you require.
3.2 It is not a failure to conform if the failure has its origin in your materials.
3.3 We will supply our services with care.
3.4 We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
4. COMPANIES WARRANTIES
4.1 The Company website and its affiliates attempt to be as accurate as possible. However, this website does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.
4.2 We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
4.3 We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
4.4 We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
4.5 You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
4.6 You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
4.7 The materials on Shelleyosman.com, Shelley Osman ~The Connection Way ® are provided on an 'as is' basis. Shelleyosman.com, Shelley Osman ~The Connection Way ® makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Shelleyosman.com, Shelley Osman ~ The Connection Way ® does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site. Individual results may vary and are not guaranteed.
Shelleyosman.com, Shelley Osman ~The Connection Way ® cannot guarantee anyone’s success when using these Connection Way tools; audios, videos, CDs, mp4s. There is only one person who can guarantee your success and that would be you.
5. CUSTOMER RESPONSIBILITIES
5.1 You must co-operate with us in all matters relating to the Connection Services, provide us and the team with access to any premises under your control as required, provide us with all information required to perform Connection services by completing the medical questionnaire upon purchase of a connection service.
5.2 Failure to comply with the above is a Customer default which entitles us to suspend performance of the Connection Services until you remedy it or if you fail to remedy it following our request, we can terminate the Contract with immediate effect on written notice to you.
6. INDEMNIFICATION
You agree to indemnify, defend and hold harmless the Shelley Osman ~ The Connection Way ® website, its parents, affiliates, employees, agents, third party information providers, service providers, licensors or the like and their respective officers, directors, employees, agents, licensors, representatives, and third party providers to the website from and against all losses, injuries, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms and Conditions by you. This website reserves the right to assume, at its sole expense, the exclusive defence and control of any matter subject to indemnification by you, in which event you will fully cooperate with the Shelley Osman ~ The Connection Way ® website in asserting any available defences.
7. DISCLAIMERS
7.1 Products and services disclaimer:
7.1.1 The products & services on this website are not offered as a replacement for qualified medical advice, diagnosis or treatment. The Content is not intended to be a substitute for professional, medical, health, nutritional or fitness advice, diagnosis, therapy or treatment. There are no medical claims intended.
Shelley Osman recommends that you consult a physician in all matters relating to your health, particularly with respect to any symptoms that may require diagnosis, treatment or medical attention. Shelley Osman makes no claims, promises, representations or warranties with respect to any information regarding your health care needs.

7.2.6 Before purchasing and using any of The Connection Way tools; audios, CDs, videos, mp4s from Shelleyosman.com, Shelley Osman ~The Connection Way ® please consult with your Doctor, or carer first, if you meet the following conditions:

7.3.2 You waive any claims against us resulting from your use of the Website and/or its Content and/or the online retreats/live events. If you feel that the use of the Website and its Content including the Content of the online retreats/events and Shelley Osman’s Service causes you any damage, we suggest stopping using its content and stopping attendance of live online events.
7.3.3 You hereby agree to release and waive any claim and liability for any loss, any physical, psychological or psychiatric injury, any damage of any kind against us arising from:

your use of the Content of this Website and/or found on other media platforms such as Facebook or YouTube;

your inability to use the Website or part of the Website and its Content at any given time;

interruptions, errors, deletions of any Content or the discontinuation of the Website in full or in part.

the fact that you disagree in any way with the Content of this Website (including the online retreats/events and/or the fact that you are not able to follow the live stream retreat/event due to any changes or adjustments to the announced schedule.
7.3.4 You agree that you will not bring any claim personally against Shelley Osman or our administrative helpers in respect of any losses, injuries or damages you suffer in connection with the Website or these Terms and Conditions.
7.3.5 You hereby agree that, to the extent permitted by applicable law, your sole and exclusive remedy for any losses, injuries, damages, problems or dissatisfaction with the participation of live events, is to stop taking part.
7.3.6 During live events, you may feel sensations such as tingling, warmth & heightened sensations, this is all part of the healing process. If you are concerned about any health issue, please contact your GP. Shelley Osman is not a GP.

Everyone's results will and can vary and are dependent on many factors, seen and unseen. This is not an exact science nor is it even a science per its definition as we know it.

8. GENERAL SERVICE TERMS
8.1 We reserve the right to refuse service to anyone for any reason at any time.
8.2 You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
8.3 The description of all of The Connection Way Services as set out in the Website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and may be subject to change.
8.4. In the case of The Connection Way Services designed to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.
8.5 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
8.6 You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
8.7. All The Connection Way Services which appear on the Website are subject to availability.
8.8 We can make changes to any of the Connection Way Services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.
8.9 You must not transmit any worms or viruses or any code of a destructive nature.
8.10 A breach or violation of any of the Terms will result in an immediate termination of your Services.
8.11 Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy (see below).
8.12 We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
9. HEALING CONNECTION TERMS
9.1 These are recurring monthly subscriptions, and may be cancelled at any time.
9.2 Please note that if you cannot attend one of the healing connection times for your plan you will not receive a refund, these are your times, if you miss a date Shelley guarantees that you will still receive the benefits of the healing connection regardless of where you are.
9.3 The reflection journal is part of this plan policy, please make sure that you are committed to sending your reflection journal via post, as stated in your healing connection instructions. Please do not forget to send your reflections in, you must commit and continue to keep up with your reflections and get them in on time.
Please send your first set of reflections one month from the date your healing connection began and every month thereafter e.g if you start on the 15th of March you would send them on the 15th of April. This is your responsibility and the admin team will not remind you more than once to do this.
We hope that The Healing Connection plan is of use to you on your spiritual journey. If you have any questions about your plan, please write to us at info@shelleyosman.com and someone will assist you.
9.4 Shelley Osman ~ The Connection Way ® has the right to make changes and update where needed and will inform you of any changes.
9.5 Booking a plan:
1. Select a price plan, click join and you will be asked to sign up by entering your name, contact details and then you can make payment.
2. Upon receipt of your plan purchase we will send you a confirmation email, this email will give you options of times and days for your connection and also a link to the Healing Connection Instructions page that will guide you through your next steps. Please reply to this email to confirm the day and time that you would like to receive your connection. You must complete the health questionnaire (this only needs to be done once, please inform us of any changes so we can keep our records up to date) and send a recent photo (we will explain how to do this on the instructions page) which you will need to complete in order to be able to attend your Healing connections session or any online event that we offer.
3. You will then be a site member with access to the website pages that are allowed under your specific plan that you have signed up for.
10. CANCELLATIONS AND REFUNDS
10.1 The Healing Connection Plan
Cancellation - You can cancel your plan at any time, please email us at info@shelleyosman.com and request this or you can cancel this yourself by logging into your account and cancelling it there. If you cancel your plan eg. in the middle of January (and you started the plan on 1st January), the plan continues until the end of January, but does not recur in the following months, therefore no further payments are taken.
You will not receive a refund for Healing Connections for the period of time that you have purchased, or a transfer of any kind to any other service or product offered on the Shelleyosman.com site For example; If you cancel half way through the month you will not receive a refund for the rest of the month that has been paid for, this plan is non-transferable to yourself or to anybody else.
Shelley Osman ~ The Connection Way ® has the right to refuse your plan registration, they also have the right to cancel a registration. This is also the case if you do not abide by the Terms and Conditions and codes of conduct for example within the forum.
10.2 Connection phone call, Zoom call or 1-2-1 Healing Connection
If you wish to cancel a pre-booked telephone Connection call, Zoom call or 1-2-1 Healing Connection with Shelley the cancellation policy below will apply:
When cancelling your appointment 48 hours before the selected date you will receive a full refund, minus the transaction fee such as Paypal or Stripe.
If you miss your appointment or cancel it with less than 48 hours’ notice your appointment will be non-refundable.
No shows for your appointment are charged 100% of the fee.
No credit or refund is available if you cancel on the day; if you do not show up; or if you leave a call early for any reason. No refund will be given after the session has taken place. No refund will be available if you attend and are dissatisfied with its presentation or content.
If you wish to reschedule your appointment:
We understand that unplanned situations can arise, and you may need to reschedule your appointment, but due to re-organisation time of the booking calendar for the admin team, we only allow one opportunity to reschedule once per person. If that happens, we respectfully ask for 48 hours’ notice.
When booking a block of appointments (i.e 2 or more) for either phone calls or 1-2-1 appointments with Shelley, please note that an expiry date of 3 months from the date of purchase will apply and therefore must be used within that period as they will be non-refundable and non-exchangeable.
Additional Fee’s:
Appointments with Shelley have set duration times, please stick to these times and do not go over the set and paid for times, otherwise a fee of £2.00 per minute will be charged. Please note there will be other people waiting for their appointments, so going over time keeps others waiting and ruins the schedule.
11. FEES
11.1 Fees are outlined in detail in our website www.shelleyosman.com
There are 3 Healing Connection plans to choose from and each plan is on a rolling monthly subscription.
11.2 There are separate and additional fees to pay for 1:1 telephone calls; 1:1 zoom calls; 1:1 Private Healing, Online events, retreats and for all products which are outlined in the detail on the website.
12. PAYMENT TERMS
12.1 Payment:
You authorise us to charge you for use of the Services, at the posted prices, (such prices subject to change at any time by shelleyosman.com, Shelley Osman ~The Connection Way ® without any specific notice to you, beyond posting notification on the website), at such times as you specify upon enrolment and continuing until you cancel your membership. All payments shall be made in GB sterling. You represent and warrant that: (i) any credit card or other payment information you supply is true and complete, (ii) charges incurred by you will be honoured by your credit card company, and (iii) you are responsible to pay the charges incurred by you at the posted prices.

12.2.1 How to successfully place your shop order:

Note: Please be sure to add info@shelleyosman.com to your list of safe email contacts in order to ensure that you can receive our shipping and order confirmation emails. If you do not receive any email from us, please be sure to check your spam or junk email folder.
12.3 Rates:
All our prices are given in British Pounds (GBP/£) and include all applicable taxes. All rights to price change are reserved. Prices exclude shipping costs. All payments must be sent to us in GBP only.

12.5 REFUNDS FOR RETREATS & EVENTS
12.5.1 Retreat cancellation policy
Where a retreat has been paid for in full via a single payment, if subsequently cancelled, the following policy applies:

Cancellation date if more than 8 weeks before the start of the retreat: 33% of the amount paid will be retained as a non-refundable deposit. The remaining 67% will be refunded back to the card on which the payment was made.

Cancellation is equal to or less than 8 weeks before the start of the retreat: The full booking becomes non-refundable as such 100% of the amount will be retained, unless due to medical necessity or emergency, for the participant or immediate family members, for which we require proper evidential documentation to refund you 50% of the amount you have paid. We will discuss with you your individual circumstances.

Retreat pricing does not include meals, lodging or transportation for the event. The registration fee covers tuition only.

No credit or refund is available if you cancel on the arrival day; if you do not show up; or if you leave an event early for any reason. No refund will be available if you attend a program and are dissatisfied with its presentation or content.

We cannot be held liable for any expenses which you may have incurred, such as if your travel gets cancelled or delayed, or you have holiday days or exchange rate losses, we will not issue a refund.

We have the right to cancel a retreat at any time. If we cancel you will receive a full refund.
12.5.2 Event cancellation policy
Event bookings are not transferable to another event, session or date. If you need to cancel an Event booking for any reason, the following cancellation policy applies:

Cancellation requests must be made to us in writing by email.
-
If you cancel 31 days or more before the date of the Event your full payment minus 25% will be refunded.
-
If you cancel from 30 days to 15 days before the date of the Event your full payment minus 75% will be refunded.
-
If you cancel 14 days or less before the date of the Event your full payment is non-refundable.
-
The above days are calendar days, not including the day on which the Event starts.
-
No refunds will be offered for no shows or cancellations made once the event has started.

Any refunds issued will be minus the PayPal (or other payment provider) or Eventbrite (or other event booking platform) fee. (This is out of our control as they do not refund their fee).
12.5.3 If we make a cancellation
We may cancel your access to any portion of the Site or Services immediately, without prior notice, for any reason whatsoever.
If we cancel a Service, you are entitled to a full refund of the amount you paid us to purchase the Service, except where the cancellation is due to a Force Majeure or where we believe that:
-
you (or someone who accesses the Site or the Services on your behalf) are in breach of these Terms of Service;
-
fraud or an unauthorized or illegal transaction is suspected; or
-
an error has occurred;
in which cases you are not entitled to any refund.
Where you are entitled to a refund of the purchase price, we accept no liability for any resulting costs suffered by you, for example travel, car parking, child care and accommodation expenses, changes in currency exchange rates, or the cost of other goods and services.
13. Force Majeure
We will not be liable, or obliged to provide any refund of monies paid, for any delay or failure to host an event, or for your inability to attend an event, directly or indirectly due to any event of Force Majeure or other cause beyond our control.
14. Exercise and Activities – Walks in nature and yoga.
You acknowledge that all exercise involves a risk of personal injury, including a small risk of serious injury or death, and you agree to take full responsibility for your health and wellbeing in relation to your use of the Services.
If you wish to participate in exercise activities associated with the Services, you acknowledge and agree that:

you suffer from no medical or physical condition that will or might increase the normal risks associated with exercise; or
-
your doctor has approved your participation in exercise activities in relation to the Services; and that
-
you will inform us as soon as possible if you suffer from any new injury, illness or other medical condition; or you feel any pain or discomfort during an exercise activity; or you feel that any exercise included with the Services would be unsafe or uncomfortable for you.
If you are over 70 years old, you must obtain your doctor’s approval before participating in exercise activities associated with the Services.
We may in our sole discretion prohibit you from participating in an exercise activity and you must comply with all of our instructions in relation to our exercise activities.
15. Physical, Mental and Social Care Needs
We will, as far as is reasonably practical, provide Services that are accessible to all. We understand that individuals who have particular physical, mental or social care needs may require additional support to access the Services.
When booking to attend an Event, you agree to inform us of the type and level of need you (or those you are making a booking for) may have. If there is a significant need, you must contact us prior to making a booking because unfortunately we cannot provide help that would normally be provided by a qualified or trained professional.
Our Services are only appropriate for those who are willing to take full responsibility for their own inner wellbeing, and for the inner wellbeing of those in their care – be it emotionally, intellectually and/or spiritually. If you are not able to take full responsibility in this regard, you are not permitted to use the Services.
We do not have the resources and cannot safely manage people in crisis, including those suffering from drug withdrawal, drug addiction, self-harming behaviours or an episode of psychosis. If you develop an acute condition while using our Services, your care is primarily your own responsibility and, where relevant, the responsibility of your next of kin and external professionals.
Although we endeavour to respond appropriately to all enquiries we receive about the Services, we are not able to manage requests for counselling or other pastoral care throughout your use of the Services.
Refusal of admission to an Event in certain circumstances
We may refuse entry to an Event or have you removed from an Event on valid grounds, including if:

you fail to comply with these Terms of Service;

we have not received payment for your ticket or you are unable to produce a ticket;
-
you are intoxicated or you behave in a threatening, disruptive or offensive manner;
-
you interfere unreasonably with another user’s enjoyment of the Services or the venue;
-
you interfere unreasonably with our staff (including volunteers) carrying out their functions; or
-
as specified elsewhere in these Terms of Service.
If we refuse entry to an Event or have you removed from an Event on valid grounds, we will not refund the price you paid for the Event and we accept no liability for any resulting damages or costs suffered by you, for example travel, car parking, child care and accommodation or other goods or assistance.
Personal information
You agree that any information that you provide to us is true, current, accurate and complete, and that you are not impersonating another person. This includes information such as your legal name, street address, email address, telephone number and financial transaction account information.
You further represent and warrant that:

you have the legal right to use the financial transaction account with which you make purchases on the Site; and
-
you grant us the right to provide your personal information to third parties where necessary to facilitate the processing of your order.
We will use information you have provided us, or that we have collected and retained relating to your use of the Site or the Services, in accordance with our Privacy Policy.
Our Site uses cookies and our Privacy Policy explains how we protect your privacy in our use of cookies and other information. You consent to our use of cookies in accordance with the terms of that policy.
All personal and sensitive information you give us will be managed in a confidential manner in accordance with our Privacy Policy. However, due to circumstances outside of our control, we cannot guarantee that all aspects of your use of the Site or the Services will be confidential due to the potential ability of third parties to intercept and access such information.
16. Photographs, Recording and Privacy at Events
You are not permitted to record, share or transmit audio, video or photographic footage of the Services. We reserve all multimedia rights.
Please note that for security reasons closed circuit television (CCTV) cameras are used at some of our Event venues.
Events will also include recording and/or live streaming of audio, video and photographic footage which may include the image, likeness and voice of anyone at the Event (“Event Footage”).
By attending and/or booking an Event, you acknowledge that the Event Footage is our property. We reserve the right to use Event Footage in whole or in part, for any purpose, at our absolute discretion. However we are not obliged to use, broadcast or provide to you any Event Footage.
If for any reason such assignment of the property rights to Event Footage is ineffective, you agree:
-
to grant us a royalty-free, non-exclusive, perpetual, irrevocable, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit the Event Footage without restriction; and
-
that we may use the Event Footage with no obligation of confidentiality, without any payment or compensation being offered, and without any request being made to you; and
-
this includes sub-licensing to our international branches the unrestricted right to exercise any of these rights granted.
You agree and acknowledge that your presence at an Event, and the presence of those who attend the Event under your booking:
-
constitutes express and irrevocable consent to our recording of attendees’ image, likeness and voice; and
-
is a waiver of any and all legal claims in relation to Event Footage, without limitation.
